If you own property in Spain, you are likely part of an owners' association (comunidad de propietarios). The Ley de Propiedad Horizontal (Horizontal Property Act) governs who is responsible for maintenance and repairs.

The flat roof of an apartment building is classified as a communal element (elemento común), even if a particular owner has exclusive use of it as a terrace. This means:

  • The community is legally responsible for maintaining the waterproofing of the roof.
  • If the roof leaks due to deterioration of the waterproof membrane, the cost falls on all owners via a special levy (derrama).
  • The community cannot refuse to carry out necessary repairs. An owner affected by leaks can demand action and, if needed, enforce it through the courts with a technical report.
